Government Does Not Intervene in Constitutional Court Decision on Election System

VOINews, Jakarta - The government has stated that it will not intervene in the decision-making process of the Constitutional Court (MK) regarding the judicial review of the legislative election system. This was conveyed by Deputy IV of the Presidential Staff Office (KSP), Juri Ardiantoro, at Bina Graha Building, Monday (29/5/2023).

According to him, currently all parties must adhere to Law Number 7/2017 on Elections before the Constitutional Court's decision. "For the government, it is clear that it is the domain of the Constitutional Court," he said.

So, continued Juri, as long as there has been no decision issued by the Constitutional Court, all hold on to the current regulations. "Currently Law Number 7/2017 has no changes," he said.

Juri's statement responded to Denny Indrayana's claim that he had received information about the Constitutional Court's decision. According to Denny, the Constitutional Court will decide to return to a closed proportional system or party voting.

"The Constitutional Court will make a decision with various considerations which of course are associated with the KPU as the election organizer," said Juri. So, he continued, the government will leave the process of organizing elections to the KPU.

Juri said the alleged leak of the Constitutional Court's decision conveyed by Denny must be investigated first. He believes the Constitutional Court has standards in responding to the circulation of information on decisions that have not been submitted.

"The government will consistently implement the Constitutional Court's orders or the law," said Juri. According to him, the government cannot presume because surely all of the Constitutional Court's decisions have been considered for their consequences and impacts.

Denny Indrayana's confession about the leaked Constitutional Court decision was conveyed through his Twitter account @dennyindranaya. He also mentioned the source at the Constitutional Court, but certainly not from constitutional judges.

Denny said the composition of the Constitutional Court judges who will decide on the lawsuit is 6:3. This means that six Constitutional Court judges agreed that the electoral system should return to closed proportional.

Meanwhile, three other judges agreed to an open proportional system. "Indonesia will return to the authoritarian and corrupt new order election system," Denny said in a tweet.

The Constitutional Court received an application for a judicial review of Article 168 paragraph 2 of Law Number 7/2017 on Elections related to the open proportional system. The application was registered with case registration number 114/PUU-XX/2022 on November 14, 2022.

The applicants consisted of six people consisting of Demas Brian Wicaksono, Yuwono Pintadi, and Fahrurrozi. Then Ibnu Rachman Jaya, Riyanto, and Nono Marijono. (RRI)
